Privacy Policy

1.2 Data We Collect. When you submit a contact form or engage our services, we may collect the following personal data: full name, email address, phone number, project details, and budget range. We do not collect sensitive personal data (health, biometric, political opinions, or religious beliefs).
1.3 Purpose of Processing. Your personal data is collected and processed for the following purposes: (a) to respond to your inquiry and provide a quote; (b) to deliver the requested services; (c) to manage our ongoing business relationship; (d) to comply with legal obligations under Spanish and EU law.
1.4 Legal Basis. We process your data based on: (a) your explicit consent given via the contact form; (b) the necessity to perform a contract or pre-contractual measures at your request; (c) our legitimate interest in maintaining and improving our services.
1.5 Data Retention. Personal data is retained for the duration necessary to fulfill the purposes for which it was collected, or as required by applicable law. Contact form submissions are retained for a maximum of 24 months. Contract-related data is retained for 6 years in compliance with Spanish tax obligations.
1.6 Third-Party Sharing. We do not sell or rent your personal data to third parties. Data may be shared with: (a) hosting and infrastructure providers necessary for website operation; (b) payment processors (Stripe) for transaction handling; (c) legal advisors when required by law. All third-party processors operate under data processing agreements compliant with GDPR Article 28.
1.7 International Transfers. Your data is primarily processed within the European Economic Area (EEA). Should any data transfer outside the EEA occur, we ensure adequate safeguards are in place, including Standard Contractual Clauses (SCCs) as approved by the European Commission.
1.8 Your Rights. Under the General Data Protection Regulation (EU) 2016/679, you have the right to: (a) access your personal data (Art. 15); (b) rectify inaccurate data (Art. 16); (c) request erasure (Art. 17); (d) restrict processing (Art. 18); (e) data portability (Art. 20); (f) object to processing (Art. 21); (g) withdraw consent at any time (Art. 7(3)). 1.9 Supervisory Authority. You have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos — AEPD) at www.aepd.es if you believe your data protection rights have been infringed.
1.10 Security. We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction, including SSL/TLS encryption, access controls, and regular security audits.
Terms of Service
2.1 Agreement to Terms. By accessing or using the services provided by stackvelocityworks, located at Avenida de America 10, 28028 Madrid, Spain, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.
2.2 Scope of Services. stackvelocityworks provides web development, platform engineering, performance optimization, and related technical services. The scope of each engagement is defined in a written proposal or statement of work (SOW) agreed upon by both parties prior to commencement.
2.3 Project Proposals & Estimates. All proposals and cost estimates are valid for 30 days from the date of issue. Final pricing is confirmed upon written acceptance of the proposal. Additional work outside the agreed scope will be quoted separately and requires written approval before execution.
2.4 Payment Terms. Unless otherwise specified in the SOW: (a) a 50% deposit is required before work commences; (b) the remaining 50% is due upon project completion and delivery; (c) payments are due within 14 days of invoice date; (d) late payments incur a 1.5% monthly interest charge. All prices are in Euros (EUR) and exclude applicable taxes (IVA/VAT).
2.5 Project Timeline. Timelines are estimates based on current workload and project complexity. stackvelocityworks will communicate any delays promptly. Delays caused by the client (e.g., late feedback, content delivery) will extend the timeline proportionally.
2.6 Intellectual Property. Upon full payment, all intellectual property rights for the deliverables are transferred to the client. stackvelocityworks retains the right to display work in portfolios and case studies unless explicitly restricted in writing. Pre-existing frameworks, libraries, and tools used in development remain the property of stackvelocityworks.
2.7 Client Responsibilities. The client agrees to: (a) provide timely access to necessary accounts, credentials, and content; (b) designate a single point of contact for project communications; (c) review and approve deliverables within agreed timeframes; (d) ensure all provided content does not infringe third-party rights.
2.8 Limitation of Liability. stackvelocityworks shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the total amount paid by the client for the specific service giving rise to the claim. We are not responsible for damages caused by third-party services, hosting failures, or client modifications post-delivery.
2.9 Confidentiality. Both parties agree to keep confidential all proprietary information shared during the engagement. This obligation survives the termination of the agreement for a period of 24 months.
2.10 Termination. Either party may terminate the agreement with 14 days written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. Deliverables completed and paid for will be transferred to the client.
2.11 Governing Law. These Terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Madrid, Spain, without prejudice to the consumer’s mandatory jurisdiction rights under EU Directive 93/13/EEC.
Refund & Reimbursement Policy
4.1 General Policy. stackvelocityworks is committed to delivering high-quality web development and platform engineering services. We offer refunds in accordance with EU consumer protection regulations and the following terms.
4.2 Right of Withdrawal. Under EU Directive 2011/83/EU, consumers have the right to withdraw from a distance or off-premises contract within 14 days of acceptance without giving any reason. To exercise this right, you must inform us of your decision by an unequivocal statement (e.g., email to [email protected]). Withdrawal must be exercised before the service has been fully performed.
4.3 Pre-Work Deposit Refund. The 50% deposit is fully refundable if cancellation is made in writing before work has commenced. Once work has begun, the deposit is non-refundable, except where the right of withdrawal applies under Section 4.2.
4.4 Partial Work Refunds. If a project is terminated by the client after work has commenced: (a) all completed and approved milestones are billable; (b) a pro-rata refund of any pre-paid amount for uncompleted work will be issued within 30 days; (c) work-in-progress at the time of termination is billable at the agreed hourly or milestone rate.
4.5 Deliverable Defects. If deliverables do not conform to the agreed scope of work as defined in the SOW, stackvelocityworks will, at its option: (a) remedy the defects at no additional cost within a reasonable timeframe; or (b) issue a partial refund proportional to the defective portion of the deliverables.
4.6 Non-Refundable Items. The following are non-refundable: (a) third-party costs incurred on behalf of the client (domain registrations, hosting fees, premium licenses); (b) work completed and approved by the client; (c) consulting hours already delivered; (d) custom development work where source code has been delivered to the client.
4.7 Refund Process. To request a refund: (a) contact [email protected] with your project details and reason for the refund request; (b) we will acknowledge your request within 48 hours; (c) refunds are processed within 14 business days of approval via the original payment method.
4.8 Dispute Resolution. If you are dissatisfied with our refund decision, you may: (a) request a review by contacting our management team; (b) use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr; (c) contact the local consumer arbitration service in Madrid, Spain.
4.9 Governing Law. This Refund Policy is governed by Spanish law and EU consumer protection regulations. The mandatory consumer jurisdiction rights under EU Directive 93/13/EEC remain unaffected.
